WWE Hall of Famer Sunny seeks to vacate conviction; initial motion denied
Tammy “Sunny” Sytch has filed a post-conviction motion seeking to have her 2023 conviction vacated; a judge initially denied the filing for procedural reasons and Sytch may appeal.
WWE Hall of Famer Tammy "Sunny" Sytch, who is serving a prison sentence due to a 2023 conviction in a fatal 2022 Florida traffic accident, has asked a court to vacate her conviction, according to reporting that the motion was filed earlier this month.
Sytch was convicted in 2023 after pleading no contest to charges tied to the March 2022 crash that killed 75-year-old Julian LaFrancis Lasseter. She was sentenced to more than 17 years behind bars for DUI manslaughter and driving without a license and causing injury/death, with a release date currently set for December 2038.
The post-conviction motion, reported by PWInsider, argues Sytch received ineffective assistance of counsel. The motion says defense attorneys failed to investigate other potential causes of Lasseter’s death, including his medical history — which the motion says included coronary artery disease, stenosis and other serious cardiovascular conditions — and toxicology results that the motion says showed Adderall and Cialis in his system. The motion also raises an alleged conflict of interest, claiming an assistant state attorney who participated in the prosecution was married to the physician who signed Lasseter’s death certificate.
Legal standards for ineffective-assistance claims require a defendant to show counsel’s performance was inadequate and that the deficiency affected the outcome, a burden that is often difficult to meet. The motion requested a new trial or other post-conviction relief.
A judge initially denied the filing because it did not meet procedural requirements for consideration. Sytch now has the option to file a motion to appeal that denial or to abandon the effort to have the conviction vacated. The judge warned that if the conviction were revisited and her plea were withdrawn, Sytch could face a longer sentence than the roughly 17 years she is currently serving.
